Terms of Use

Last updated October 29, 2026

Please read these Terms carefully. They explain what the Service is, what it is not, and the rules that apply to your accounts and payouts.

1. Agreement to these terms

These Terms of Use ("Terms") are a binding agreement between you and Avenor Markets ("Avenor", "we", "us" or "our"). They govern your use of avenormarkets.com, the Avenor trading application at app.avenormarkets.com, and every evaluation, funded account, payout and related service we provide (together, the "Service").

By creating an account, buying an evaluation or otherwise using the Service, you agree to these Terms, the Trading Rules, the Privacy Policy, the Risk Disclosure and the Refund Policy, each of which forms part of these Terms. If you do not agree, do not use the Service.

2. Eligibility and restricted jurisdictions

To use the Service you must:

  • be at least 18 years old and the age of majority where you live;
  • have the legal capacity to enter into these Terms;
  • pass our identity verification before any payout; and
  • not be a person or entity named on, owned or controlled by anyone named on, or acting for anyone named on, a sanctions list maintained by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the United Nations, the European Union or the United Kingdom.

Restricted jurisdictions. The Service is not offered to, and may not be used by, anyone who resides in, is located in, or is a citizen or national of a country or region subject to comprehensive OFAC sanctions or otherwise restricted by us. These currently include: Cuba, Iran, North Korea, Syria, Russia, Belarus, the Crimea region, the so-called Donetsk People's Republic, the so-called Luhansk People's Republic, Myanmar. The Service is also not available in any jurisdiction where offering or using it would be unlawful. We may add jurisdictions to this list at any time.

You may not use a VPN, proxy or other means to hide your location or to access the Service from a restricted jurisdiction. If we determine that you are not eligible, we may close your accounts, and fees paid and amounts shown in any account are forfeited to the extent permitted by law.

3. The Service is simulated

All trading on Avenor is simulated. Evaluations and funded accounts are simulated trading accounts that use live or delayed market data. No orders you place are sent to an exchange or a live market, no securities, futures, commodities, digital assets or other financial instruments are bought or sold for you, and no account holds real capital.

  • Avenor is not a broker, dealer, futures commission merchant, introducing broker, commodity trading adviser, investment adviser, exchange or custodian, and does not hold client funds.
  • Account balances, profits and losses are simulated figures used to measure your performance. They are not deposits, are not your property, and cannot be withdrawn except as a payout under section 9.
  • Nothing in the Service is investment, financial, tax or legal advice, or a recommendation to buy or sell any instrument.
  • Using the Service does not make you an employee, partner, agent or joint venturer of Avenor, and does not give you any right to trade Avenor's capital.

4. Your account

  • One person, one set of accounts. You may hold only one Avenor user profile. Every evaluation and funded account must be opened in your own legal name and traded only by you.
  • You must give accurate, current and complete information and keep it up to date.
  • You are responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately at support@avenormarkets.com if you suspect unauthorised access.
  • You may hold up to ten funded accounts at a time, as described in the Trading Rules.

5. Identity verification

We require identity verification ("KYC") before your first payout and may require it, or further checks, at any other time. Verification is performed with a third-party provider and may include a government-issued photo ID, a live selfie and proof of address. The name on your verified identity must match your Avenor account and your payout method. We may refuse, delay or cancel a payout, or close accounts, if you do not complete verification, if verification fails, or if we suspect the information you gave is false.

6. Evaluations, fees and payment

  • What the fee buys. The fee for an evaluation, reset or add-on pays for access to a simulated evaluation service: the trading platform, market data, risk monitoring and review. It is not a deposit, an investment or a purchase of any financial instrument, and it is not held for you.
  • Prices. Prices are shown at checkout in U.S. dollars. Launch or promotional prices apply only to purchases made while they are offered and are not applied to earlier purchases. We may change prices for future purchases at any time.
  • Payment. Payments are processed by third-party payment providers. You authorise us and them to charge your chosen payment method. You are responsible for any bank, currency or card fees and for any taxes that apply to your purchase.
  • Activation fee. Futures plans charge a one-time activation fee, shown on the plan before you buy, only after you pass the evaluation. Your funded account is activated when it is paid. The activation fee is not covered by promotional codes and is non-refundable once the funded account is active. Perps plans have no activation fee.

7. Refunds

You may request a full refund of an evaluation fee within 14 days of purchase if no trade has been placed on that evaluation. Once a trade has been placed, the fee is non-refundable. Full details are in the Refund Policy.

8. Trading Rules

Your evaluations and funded accounts are governed by the Trading Rules, including profit targets, drawdown, daily loss limits, consistency, position limits, the short-trade rule, account limits and prohibited conduct. If an account breaks a rule that ends the account, the account is closed and cannot be restored except as the Trading Rules allow. We may update the Trading Rules as set out there.

9. Funded accounts and payouts

  • Performance rewards. A payout is a performance reward that Avenor pays from its own funds, calculated from your simulated results under the Trading Rules. It is not a return of capital, a share of trading profits from any live account, wages or a salary.
  • Discretion and review. Payouts are paid at Avenor's discretion, which we exercise in good faith and in line with the Trading Rules. Every request is reviewed. We may reduce or deny a request, or remove profits from an account, where a rule was broken or the results came from prohibited conduct.
  • Conditions. Before any payout you must have completed identity verification, accepted any trader agreement we require, and provided a valid payout method in your own name. Payout caps, minimums, splits and eligibility are set by your plan.
  • Deduction. The requested amount is deducted from the simulated account when you request it.
  • Taxes. You are responsible for reporting and paying any taxes on payouts. We may ask for tax forms and may withhold where the law requires.
  • Recovery. If a payout is later found to have been made because of an error, fraud or a rule violation, you must repay it on request, and we may set it off against amounts otherwise due to you.

10. Prohibited conduct

In addition to the prohibited trading conduct in the Trading Rules, you must not:

  • let anyone else access or trade your account, or access or trade anyone else's account;
  • open accounts under false, borrowed or multiple identities;
  • hedge across accounts, coordinate trades with other traders, or exploit errors, latency, data faults or other features of the simulated environment;
  • copy, scrape, reverse engineer or interfere with the Service, or use bots or automation to access the Service other than through the trading features we provide;
  • redistribute market data or other content from the Service;
  • file a chargeback or payment dispute for a service you received;
  • harass, threaten or abuse our staff or other users; or
  • use the Service for any unlawful purpose, including money laundering or sanctions evasion.

11. Suspension and termination

You may close your account at any time by contacting support. We may suspend or close any or all of your accounts, deny or reduce payouts, and refuse future purchases if we reasonably believe that you have broken these Terms or the Trading Rules, given false information, engaged in fraud or abuse, or become ineligible, or if we are required to by law. Where an account is closed for a violation, fees are not refunded and simulated balances, profits and pending payouts connected to the violation are forfeited. We may also stop offering the Service, or any part of it, at any time; if we do, we will treat open evaluations fairly and tell you how.

12. Market data

The Service shows market data from exchanges and data providers, including CME Group. Market data is licensed to us and provided to you for your own personal, non-commercial use within the Service. You may not copy, store, redistribute or display it outside the Service. Some exchanges require you to agree to their subscriber terms and to declare whether you are a professional or non-professional user; you must answer truthfully, and professional users may be charged additional fees or refused. Market data may be delayed, interrupted or inaccurate, and neither we nor any data provider guarantee it. CME Group is not affiliated with Avenor and does not endorse the Service.

13. Intellectual property

The Service, including its software, design, text, graphics, the Avenor name, logo and the Vantage mascot, belongs to Avenor or its licensors and is protected by law. We give you a limited, personal, revocable, non-transferable licence to use the Service under these Terms. You may not use our names or marks without written permission.

14. Third-party services

The Service relies on third parties for payments, payouts, identity verification, market data and hosting. Their services are governed by their own terms, and we are not responsible for their acts or omissions, although we choose them with care.

15. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, Avenor disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure or free of errors, that simulated fills will match what a live market would have done, or that you will pass an evaluation or receive any payout. Past simulated performance does not indicate future results.

16. Limitation of liability

To the fullest extent permitted by law, Avenor and its owners, officers, employees and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, opportunity or goodwill, arising out of or relating to the Service, even if advised of the possibility.

Our total liability for all claims arising out of or relating to the Service or these Terms is limited to the total fees you paid to Avenor in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

17. Indemnity

You agree to indemnify and hold harmless Avenor and its owners, officers, employees and service providers from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your breach of these Terms or the Trading Rules, your misuse of the Service, or your violation of any law or the rights of a third party.

18. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Before starting any formal proceeding, you agree to contact legal@avenormarkets.com and try in good faith to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be brought only in the state or federal courts located in the State of Delaware, and you and Avenor consent to their jurisdiction. To the extent permitted by law, claims may be brought only on an individual basis and not as a plaintiff or class member in any class or representative proceeding.

19. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. If a change is material, we will give notice on the site or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept it.

20. General

These Terms, with the documents they incorporate, are the entire agreement between you and Avenor about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Sections that by their nature should survive termination, including sections 9, 11 and 15 to 18, survive.
